1. About Angelic Designs by Laura

Throughout these Terms and Conditions, “Laura”, “we”, “us” and “our” mean Angelic Designs by Laura. “You” and “your” mean the customer purchasing or using our products or website.


2. About these terms

These Terms and Conditions apply when you:

· visit or use our website;

· purchase an item through our website;

· order an item by email, telephone or social media;

· request a personalised or made-to-order product;

· purchase a gift card; or

· ask us to preserve flowers or personal items in a Sacred Memory Keepsake.

Please read these terms before placing an order. By placing an order, you agree to be bound by them.

Nothing in these terms affects your statutory rights under UK consumer law.


3. Who may place an order

You must be at least 18 years old to place an order.

Anyone under 18 must have the permission and supervision of a parent or legal guardian.

You must provide accurate and complete contact, payment, personalisation and delivery information.


4. Our handmade products

Our products are individually handmade. This means that small variations in colour, texture, pattern, finish, size and positioning may occur.

These natural handmade variations make every piece unique and will not normally be considered faults.

Colours may also appear slightly different on different computer, tablet or telephone screens.

We take reasonable care to ensure that product photographs, measurements, prices and descriptions are accurate. Photographs may sometimes include decorative items that are not included with the product. The product description will explain what is included.


5. Eco-resin, epoxy resin and natural materials

Some products are created using eco-resin, epoxy resin, dried flowers or other natural and handmade materials.

Small air bubbles, surface markings, colour changes, variations or minor imperfections can naturally arise during the making, drying or curing process. These are part of the handmade character of the product and are not necessarily faults.

Natural flowers may change colour, darken, fade, become translucent or alter in appearance during drying or resin preservation. We will take reasonable care, but an exact colour or appearance cannot be guaranteed.


6. Personalised and made-to-order products

Personalised and made-to-order products may include names, wording, dates, colours, flowers, photographs, personal objects, team colours or other customer-requested details.

You are responsible for checking that all information you provide is correct, including:

· names and spelling;

· dates;

· wording and messages;

· colour choices;

· measurements;

· photographs or designs; and

· delivery details.

Where we send you a design, wording or layout for approval, you must check it carefully. Once you approve it, we may begin making the product.

We are not responsible for errors that appeared in information or a design that you supplied or approved, unless we made a separate mistake when producing the item.

We may refuse any personalisation request that we reasonably believe is unlawful, offensive, discriminatory, infringes another person’s rights or is unsuitable for our products.

By supplying wording, photographs, logos, designs or other material, you confirm that you have permission to use them and that our use of them to complete your order will not infringe anyone else’s rights.


7. Sacred Memory Keepsakes

Sacred Memory Keepsakes may preserve wedding flowers, funeral or remembrance flowers, baby keepsakes and other sentimental items within resin.

Before accepting an order, Laura will discuss:

· the flowers or items to be preserved;

· the requested shape and size;

· available designs;

· the likely finished appearance;

· the price;

· the expected production time; and

· arrangements for delivering the items to Laura.

You acknowledge that placing flowers or personal items into resin is normally permanent and irreversible.

Please do not send irreplaceable, exceptionally valuable or fragile items without discussing them with Laura first.

Unless Laura arranges collection, you are responsible for the safe packaging and delivery of your flowers or personal items until they are received by Laura. We strongly recommend using a tracked and appropriately insured delivery service.

Laura will take reasonable care of customer-supplied items while they are in her possession.

The treatment of unused flowers, offcuts or personal items will be agreed with you. They may be returned with the finished keepsake or disposed of with your permission.

No guarantee can be given that every flower or item supplied will be suitable for preservation. Laura will contact you where an item appears unsuitable or where the requested design cannot reasonably be completed.


8. Placing an order

Products may be ordered using a website Buy Now button or by contacting Laura to discuss a personalised or made-to-order item.

Your order is an offer to purchase the product.

A contract is formed when Laura sends you confirmation that the order has been accepted or, for an agreed personalised order, when Laura confirms the final specification and accepts payment.

An automated payment receipt from PayPal or another payment provider does not necessarily mean that the order has been accepted.

We may decline or cancel an order before acceptance where:

· the product is unavailable;

· materials are unavailable;

· the price or description contained an obvious error;

· we cannot meet the requested deadline;

· we cannot deliver to the requested address;

· payment has not been authorised; or

· the personalisation request cannot reasonably be completed.

Where payment has already been taken for an order that we cannot accept, we will issue a full refund.


9. Changing an order

Please contact Laura immediately if you need to change an order.

Changes cannot be guaranteed once materials have been purchased or work has begun.

A change may affect the price, production time or delivery date. Any additional charge will be explained and agreed before the change is made.


10. Prices

All prices are shown in pounds sterling.

Prices include any taxes that are legally required to be included. Delivery charges are shown separately or confirmed before the order is accepted.

The price payable will be the price shown or agreed when the order is placed.

We may change prices at any time, but a price change will not affect an order that has already been accepted.

Where a website price is clearly incorrect because of an obvious mistake, we are not required to provide the product at the incorrect price. We will contact you and give you the choice of paying the correct price or cancelling the order for a full refund.


11. Payment

Payment may be made through PayPal or by Bank Transfer.

Personalised and made-to-order products normally require payment before work begins, unless Laura agrees otherwise in writing.

Payments are processed by third-party payment providers. We do not receive or store your complete card details.

You are responsible for ensuring that you are authorised to use the payment method provided.


12. Production times

Because many products are handmade or made to order, production times may vary.

An estimated production or dispatch time will be shown on the website or agreed with you before your order is accepted.

Personalised products and Sacred Memory Keepsakes may require longer than standard products.

Any production date is an estimate unless Laura has expressly confirmed that the date is guaranteed.

Please tell Laura before ordering where an item is required for a birthday, wedding, funeral, anniversary or another important date. Acceptance of an order does not automatically guarantee delivery by that date unless this has been expressly agreed.


13. Delivery

Available delivery destinations, delivery charges and any restrictions will be shown on the website or confirmed before your order is accepted.

Unless a different delivery time has been agreed, goods will be delivered without undue delay and no later than 30 days after the contract is formed.

Delivery estimates may begin after the product has been made, particularly for personalised and Sacred Memory Keepsake orders.

You are responsible for providing a complete and accurate delivery address.

Please contact Laura promptly if you realise that the address provided is incorrect. We cannot guarantee that an address can be changed after an item has been dispatched.

The goods remain our responsibility until they are delivered into your physical possession or to a person you have identified to receive them.

Where you arrange your own independent carrier, responsibility for the goods passes to you when the goods are handed to that carrier.


14. Delivery delays

We will contact you where we become aware of a significant production or delivery delay.

We are not responsible for delays caused by circumstances outside our reasonable control, but we will take reasonable steps to reduce the effect of the delay.

Where an agreed essential delivery date cannot be met, or where delivery is significantly delayed, you may have the right to cancel the order and receive a refund.


15. Missed, refused or returned deliveries

You are responsible for making reasonable arrangements to receive your delivery.

Where an order is returned to us because:

· an incorrect address was supplied;

· delivery was refused;

· the parcel was not collected; or

· the delivery company was unable to complete delivery after reasonable attempts,

we will contact you to arrange redelivery.

You may be asked to pay the reasonable cost of redelivery where the failed delivery was caused by incorrect information or a failure to collect the parcel.

This does not apply where the delivery failure was caused by us or our delivery provider.


16. Your right to cancel a standard product

For most standard, non-personalised products ordered online, by telephone or by email, you have the right to change your mind.

You must tell us that you wish to cancel within 14 days beginning the day after you, or a person nominated by you, receives the product.

You may cancel by emailing adblaura12@gmail.com, using the website contact form or using the cancellation form at the end of these terms.

You do not have to give a reason.

After telling us that you wish to cancel, you must return the product within a further 14 days.


17. Products that cannot be cancelled because you changed your mind

The statutory change-of-mind cancellation right does not apply to goods that are:

· made to your individual specifications;

· clearly personalised;

· created using names, wording, dates, photographs or designs supplied by you;

· made using a unique colour or design specification agreed specifically for you;

· created using your flowers, keepsakes or personal belongings; or

· otherwise made in a way that means they cannot reasonably be resold.

This exception only applies where the product is genuinely made to your specifications or clearly personalised.

Simply choosing a standard item or selecting from standard stock options may not remove your cancellation rights.

You may still cancel a personalised order before it is accepted. You should contact Laura immediately if you wish to do so.

Once an accepted personalised order has entered production, Laura may not be able to agree to cancellation.

Your right to a remedy for a faulty, damaged, unsafe or incorrectly made personalised product is not affected.


18. Returning a standard product after cancellation

Before returning a product, please contact Laura for the correct return address and instructions.

Unless the product is faulty, damaged, incorrect or not as described, you are responsible for the direct cost of returning it.

We recommend obtaining proof of postage and using suitable protective packaging.

You may examine a product as you would reasonably be allowed to do in a shop. We may make a lawful deduction from the refund where the product’s value has been reduced because it was handled beyond what was necessary to establish its nature, characteristics and function.

Products should be returned with any accessories, packaging or included items where reasonably possible.


19. Refunds following a change-of-mind cancellation

Where you validly cancel a standard product, we will refund:

· the price paid for the returned product; and

· the cost of our least expensive standard delivery option.

We are not required to refund the additional cost of an enhanced, express or premium delivery service chosen by you.

The refund will be made using the same payment method used for the original purchase, unless you expressly agree otherwise.

We may wait until we receive the returned product or evidence that it has been sent back before issuing the refund.

The refund will be issued without undue delay and no later than 14 days after the returned goods or satisfactory evidence of return is received.


20. Faulty, damaged or incorrect products

All products must be:

· of satisfactory quality;

· fit for their usual purpose;

· fit for any particular purpose agreed with Laura; and

· as described.

Please contact Laura as soon as reasonably possible where a product:

· arrives damaged;

· is faulty;

· is unsafe;

· is not as described;

· is different from the item ordered; or

· contains a production or personalisation mistake made by us.

Please provide your name, order information, a description of the problem and, where possible, clear photographs.

Do not dispose of the product or packaging until Laura has had a reasonable opportunity to consider the problem.

Where the product is faulty, damaged, incorrect or not as described, we will provide the remedy required by law. Depending on the circumstances, this may include a refund, repair or replacement.

We will pay reasonable return costs where goods are returned because they are faulty, damaged, incorrect or not as described.

A minor handmade variation that was clearly explained before purchase will not necessarily amount to a fault.


21. Damage after delivery

We are not responsible for damage caused after delivery by:

· accidental damage;

· misuse;

· dropping or impact;

· improper cleaning;

· exposure to excessive heat, water or direct sunlight;

· failure to follow care instructions;

· unauthorised repair or alteration; or

· ordinary wear and tear.

This does not limit your rights where the product was already faulty when supplied.


22. Product care and safety

Please follow any care or safety information supplied with the product.

Unless the product description expressly says otherwise:

· decorative resin products are not toys;

· decorative trays and containers are not intended for direct food contact;

· products should be kept away from naked flames and excessive heat;

· dried flowers should not be watered;

· fragile items should be handled carefully; and

· small decorative items should be kept away from babies, young children and pets.

Customers are responsible for deciding whether a product is suitable for its intended location and recipient.


23. Gift cards

Angelic Designs by Laura gift cards may only be used to purchase eligible products directly from Angelic Designs by Laura.

Gift cards:

· cannot be exchanged for cash;

· cannot be used to purchase another gift card;

· must be protected as they may not be replaceable if lost or stolen;

· may be used towards an order of a higher value, with the remaining balance paid separately; and

· are subject to any expiry date or special conditions clearly shown on the gift card or supplied before purchase.

Where the value of an order is lower than the value of the gift card, any remaining balance will remain available until the card expires, unless otherwise stated.

A gift card does not guarantee that a particular product, colour or design will remain available.

Your statutory rights relating to faulty goods purchased using a gift card remain unaffected.


24. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions.

Unless otherwise stated, promotional offers:

· cannot be exchanged for cash;

· cannot be combined with another promotion;

· apply only during the stated promotional period; and

· may be withdrawn or corrected where published in error.

Withdrawal of a promotion will not affect an order already accepted at the promotional price.


25. Website availability

We take reasonable care to keep the website available, accurate and secure.

We do not guarantee that the website will always be uninterrupted, error-free or available.

We may temporarily suspend or change the website for maintenance, security, technical or business reasons.


26. Acceptable use of the website

You must not:

· misuse the website;

· attempt to gain unauthorised access to the website or its systems;

· introduce viruses, malicious code or harmful material;

· use the website for unlawful or fraudulent purposes;

· copy or exploit website content for commercial purposes without permission; or

· interfere with another person’s use of the website.


27. Intellectual property

The website and its content, including product designs, photographs, descriptions, wording, logos, graphics and branding, belong to Angelic Designs by Laura or are used with permission.

You may view and print website content for your personal, non-commercial use.

You must not reproduce, sell, distribute, modify, publish or commercially use our content or product designs without prior written permission.


28. Third-party services and links

The website may contain links to or use services supplied by third parties, including PayPal, card-payment providers, delivery companies, website hosts and social-media platforms.

These third parties have their own terms and privacy policies.

We are not responsible for the content or availability of an independent third-party website. This does not affect our responsibility for fulfilling your order or your consumer rights.


29. Our responsibility to you

We are responsible for losses that are a foreseeable result of our failure to comply with these terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Our products are supplied for private and domestic use. We are not responsible for business losses, loss of profit, loss of revenue or loss of business opportunity arising from a customer using a product for commercial purposes.

Nothing in these terms excludes or limits liability for:

· death or personal injury caused by negligence;

· fraud or fraudulent misrepresentation;

· breach of your statutory consumer rights; or

· any other liability that cannot legally be excluded.


30. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, postal disruption, carrier failure, fire, flood, power failure, illness, material shortages or disruption to online payment services.

We will contact you as soon as reasonably possible where such an event materially affects your order.

Where the delay is likely to be substantial, you may contact us to cancel the affected order and receive a refund for goods that have not been supplied.


31. Personal information

We use personal information in accordance with our Privacy Policy.

Personal information may be shared with payment providers, delivery companies and other service providers where necessary to process and complete an order.

Please do not provide sensitive or unnecessary personal information in a personalisation request.


32. Complaints

We want every customer to be happy with their order.

We will acknowledge and investigate complaints fairly and aim to respond within a reasonable time.

Nothing in this section prevents you from obtaining independent advice about your consumer rights.


33. Changes to these terms

We may update these Terms and Conditions from time to time.

The terms applying to your order will be the version made available to you when your order was accepted.

The latest version will be published on our website with the date it was last updated.


34. Severability

If a court or relevant authority decides that any part of these terms is unlawful or unenforceable, the remaining sections will continue to apply.


35. Delayed enforcement

If we do not immediately enforce a right under these terms, this does not mean that we have given up that right.


36. Transfer of the contract

We may transfer our rights and obligations under a contract to another organisation where this does not adversely affect your rights.

You may only transfer your rights or obligations under a contract with our written agreement, except where the law allows otherwise.


37. Third-party rights

The contract is between you and Angelic Designs by Laura.

No other person has a right to enforce its terms, except where the law expressly provides otherwise.


38. Governing law

These terms and any contract between you and Angelic Designs by Laura are governed by the law of England and Wales.

As a consumer, you will retain any mandatory legal protections that apply in the part of the United Kingdom where you live.

You may bring legal proceedings in the courts that have jurisdiction where you live.
